Welcome to OBCFaces ("OBC", "we", "us", "our"). OBCFaces is an online beauty contest and user-generated-content platform (the "Platform").
These Terms of Service ("Terms") govern your access to and use of the Platform, including all contests, voting systems, referral programs, messaging features, and any other services provided on or through obcface.com.
By accessing, registering, or using the Platform in any manner, you confirm that you have read, understood, and agree to be bound by these Terms, as well as our:

8.2. By uploading or submitting content, you grant OBCFaces a non-exclusive, worldwide, royalty-free, sublicensable license to:
in connection with the Platform, contests, and marketing activities.
This license covers your name, image, likeness, and all content you submit — including participation photos and videos, Finalist Diary clips and reels, live streams and their recordings, captions, and voice recordings. It includes broadcasting, simulcasting, and re-publishing such content on our official accounts on third-party platforms and social networks (such as Instagram, Facebook, TikTok, and YouTube). For content you submit to any contest, this license is also granted on the perpetual, irrevocable, royalty-free, and sublicensable basis set out in the Contest Terms (Media Release).
8.3. This license applies to all current and future contests and promotions on the Platform.
8.4. Our property. The Platform itself — including its software, source code, design, layout, look and feel, text, graphics, logos, and the names OBC and OBCFaces, together with the selection, arrangement, and compilation of all content — is owned by OBCFaces or its licensors and is protected by copyright, trademark, and other laws. Except for user content, all rights are reserved.
8.5. Limited licence to you. We grant you a personal, limited, revocable, non-exclusive, non-transferable, and non-sublicensable licence to access and use the Platform for your own personal, non-commercial use under these Terms. You may not, and may not allow anyone else to: (a) scrape, crawl, harvest, data-mine, index, cache, or use any bot, spider, or automated means to access or copy content from the Platform; (b) copy, reproduce, bulk-download, republish, mirror, frame, or redistribute any part of the Platform or its content, including the photos and videos of other users, outside the intended features of the Platform; (c) reverse engineer or attempt to extract source code; (d) remove or alter any proprietary notices; or (e) use the Platform or its content to build, train, or populate any competing product, dataset, or machine-learning model. We may revoke this licence and block access for any violation.
8.6. Copying by others. The Platform is public by design. You understand that any content shown publicly — including participant photos and videos, profile details, rankings, and our own text and design — can be viewed, screenshotted, copied, downloaded, scraped, recorded, or redistributed by third parties to other sites, social networks, or apps that we do not own or control. To the maximum extent permitted by law, OBCFaces is not responsible or liable for, and has no duty to prevent, monitor, or remedy, any copying, scraping, reposting, or other use or misuse of content by any third party, whether on or off the Platform. By making content public you accept this risk. If your content is copied or misused, you may notify us at support@obcface.com and use the copyright procedure in these Terms; primary responsibility for pursuing third parties rests with the affected rights holder.
8.7. Worldwide visibility, indexing, and persistence. By creating an account or publishing content, you agree that public content and public profile elements (such as your displayed name, photos, videos, country, and rankings) are made available to an unlimited number of persons and may be displayed to users in any country of the world, including outside your country of residence. Public pages may be indexed and cached by search engines and shown in search results, and may be embedded or re-shared through the Platform's sharing features. After deletion, copies may persist for a limited period in backups, caches, and third-party search indexes that we do not control; removal from the Platform does not undo copying that occurred earlier (Section 8.6).

12.1. The Platform and all content, features, and services are provided as is and as available, with all faults and without warranty of any kind. To the maximum extent permitted by law, OBCFaces disclaims all warranties, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Platform will be uninterrupted, timely, secure, error-free, or free of harmful components, or that any content posted by users is accurate, lawful, or non-infringing.
12.2. To the maximum extent permitted by law, OBCFaces and its owners, employees, and agents shall not be liable for:

12.3. Liability cap. To the maximum extent permitted by law, the total aggregate liability of OBCFaces for all claims relating to the Platform will not exceed the greater of (a) the total amount you paid to us, if any, in the twelve (12) months before the event giving rise to the claim, or (b) USD 100.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, such as liability for death or personal injury caused by negligence, for fraud, or for certain mandatory consumer rights. Where a jurisdiction does not allow some of the above exclusions or limitations, they apply to you only to the fullest extent permitted there.
You agree to defend, indemnify, and hold harmless OBCFaces and its owners, officers, employees, agents, licensors, and service providers from and against any and all claims, demands, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to:

These Terms are governed by the laws of the Republic of Kazakhstan, without prejudice to mandatory consumer protection laws applicable in your jurisdiction.
Any disputes shall be resolved by the competent courts of Almaty, Kazakhstan, unless otherwise required by mandatory law.

We respect intellectual property rights and respond to clear notices of alleged infringement. If you believe content on the Platform infringes your copyright, send a written notice to support@obcface.com that includes: (1) your name and contact details; (2) identification of the copyrighted work; (3) the location (URL) of the allegedly infringing content; (4) a statement that you have a good-faith belief the use is not authorized; (5) a statement, under penalty of perjury, that the information is accurate and that you are the rights holder or authorized to act on its behalf; and (6) your physical or electronic signature.
Counter-notice. If your content was removed and you believe this was a mistake, you may send a counter-notice to the same address with the corresponding information and statements.
Repeat infringers. In appropriate circumstances we will disable or terminate the accounts of users who are repeat infringers.
You use the Platform voluntarily and at your own risk. You acknowledge that the Platform is public, that participation may expose your image, likeness, and information to a wide audience, and that you may be contacted by, interact with, or have disputes with other users or third parties.
To the maximum extent permitted by law, you release and discharge OBCFaces and its owners, employees, and agents from any and all claims and damages of every kind arising out of or connected with: (a) any dispute or interaction between you and any other user or third party; (b) the conduct of any third party, including the copying, misuse, or redistribution of your content; and (c) your decision to make your content or information public. Where applicable law limits a general release, this release applies to the fullest extent permitted.
Governing language. These Terms are drafted in English. Translations are provided for convenience only. In the event of any conflict between the English version and a translated version, the English version prevails, except where the mandatory law of your country requires the local-language version to govern.
Order of precedence. These Terms incorporate the Privacy Policy, the Contest Terms, and the Cookie Policy. In the event of a conflict, the following order applies: (1) for contest participation, prizes, and media rights, the Contest Terms; (2) for personal-data processing, the Privacy Policy; (3) for all other matters, these Terms.
Severability. If any provision is held invalid or unenforceable, it will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
Entire agreement; no waiver; assignment. These Terms, together with the documents they incorporate, are the entire agreement between you and OBCFaces regarding the Platform. Our failure to enforce any provision is not a waiver. You may not assign these Terms without our consent; we may assign them, including in connection with a merger or sale of assets.
Survival. Provisions that by their nature should survive — including content licenses already granted, intellectual property, disclaimers, limitation of liability, indemnification, and release — survive termination of these Terms or your account.
Force majeure. OBCFaces is not liable for any failure or delay caused by events beyond its reasonable control, including natural disasters, war, civil unrest, government action, sanctions, epidemics, labor disputes, power or internet failures, denial-of-service attacks, or failures of third-party hosting, payment, or telecommunications providers.
No agency; no third-party beneficiaries. Nothing in these Terms creates any employment, agency, or partnership relationship. These Terms are for the benefit of you and OBCFaces only, except that our affiliates, officers, employees, and service providers are intended beneficiaries of the disclaimer, limitation-of-liability, indemnification, and release provisions.
Electronic communications. You consent to receive communications from us electronically and agree that electronic agreements, notices, and disclosures satisfy any requirement that they be in writing.
