Terms & Conditions for All Contests

1. General Provisions

• 1.1. Participation in contests is voluntary and always free of charge. NO PURCHASE, PAYMENT, OR DONATION OF ANY KIND IS NECESSARY TO ENTER, VOTE, OR WIN, and making any payment would not improve a participant's chances of winning.
• 1.2. Participation is strictly limited to individuals who are at least eighteen (18) years old at the time of submission.
• 1.3. All contests are conducted online and do not require physical presence.
• 1.4. The Organizer reserves the right, at its sole discretion, to refuse participation, suspend participation, disqualify a participant, or annul results or prizes without prior notice or explanation if there is any suspicion of a violation of these Terms.
• 1.5. No purchase necessary; void where prohibited. This contest is intended as a free, skill- and merit-based contest and is void where prohibited or restricted by law. The Organizer makes no offer of the contest in any jurisdiction where prize contests, public-vote contests, or skill competitions of this type require a licence, registration, or bond, or are otherwise restricted, and may exclude participants from, or withhold prizes in, any such jurisdiction. It is each participant's responsibility to ensure that participation is lawful where they reside.
• 1.6. Employees, officers, contractors, and agents of the Organizer and its affiliates, and their immediate family and household members, are not eligible to win prizes. Each participant may hold one account and submit one entry per contest unless a specific contest expressly states otherwise.
• 1.7. These Terms are supplemented by our Terms of Service and Privacy Policy, which are incorporated by reference — including their provisions on intellectual property, prohibited copying and scraping, disclaimers, limitation of liability, indemnification, release, and the handling of content copied by third parties.

2. Applicability to All Contests

2.1. These Terms apply to ALL contests hosted on the Website, including but not limited to:

• weekly contests
• local contests
• seasonal contests
• annual contests
• international contests
• special, one-time, test, or promotional contests
• any future contests or formats introduced by the Organizer

2.2. Specific contest rules may supplement these Terms but shall not limit or override them.

3. Accuracy of Information and Participant Responsibility

• 3.1. The participant represents and warrants that all information provided is accurate, current, and complete, and that all submitted photos, videos, and data belong to the participant and do not infringe upon the rights of any third party.
• 3.2. The Organizer bears no responsibility for false, misleading, or inaccurate information provided by the participant or for any consequences arising therefrom.
• 3.3. In the event of violations, the Organizer may retroactively annul participation, results, and prizes.

4. Personal Data and International Compliance

• 4.1. By submitting personal data, the participant consents to its processing in accordance with the EU/UK GDPR (Regulation 2016/679), the California Consumer Privacy Act / CPRA, the Philippine Data Privacy Act of 2012 (Republic Act No. 10173), the Russian Federal Law No. 152-FZ on Personal Data, the Ukrainian Law No. 2297-VI on Personal Data Protection, the Kazakhstan Law No. 94-V on Personal Data and Their Protection, the Kyrgyz Law No. 58 on Personal Information, the Brazilian LGPD (Law No. 13,709/2018), the Nigeria Data Protection Act 2023, the Kenya Data Protection Act 2019 (No. 24 of 2019), the Ghana Data Protection Act 2012 (Act 843), the Belarus Law No. 99-Z on Personal Data, and any other data protection law applicable in the participant's country of residence.
• 4.2. Data processing may include collection, storage, use, transfer to third parties (including hosting, analytics, payment, and marketing service providers), and cross-border data transfer. Where required by law, the Organizer relies on Standard Contractual Clauses or equivalent safeguards.
• 4.3. Data may be stored and processed outside the participant's country of residence. Russian participants acknowledge that initial collection of their personal data is performed in databases located on the territory of the Russian Federation as required by Federal Law No. 152-FZ; Kazakhstani participants acknowledge the equivalent in-country collection requirement under Law No. 94-V; after which the data may be transferred abroad under the safeguards described in the Privacy Policy.
• 4.4. Submitted photos and videos may include biometric facial information. To the extent such data qualifies as a special category under Article 9 GDPR or equivalent local law, the participant gives EXPLICIT consent to its processing for identity verification, fraud prevention, contest moderation, and public display in line with these Terms.
• 4.5. The participant warrants that they are at least eighteen (18) years old at the time of submission. The Organizer may request a government-issued identity document, a real-time selfie, or other reasonable evidence to verify age. Failure to provide such evidence on request results in immediate disqualification and deletion of the application.
• 4.6. The participant may withdraw consent or exercise any data subject right at any time by writing to support@obcface.com. Withdrawal does not affect the lawfulness of processing carried out before withdrawal and may be limited by the legitimate interests of the Organizer or other legal grounds (for example, retention required for fraud prevention or tax records).
• 4.7. Supervisory authorities the participant may contact: in the EU/EEA — their national Data Protection Authority; in the United Kingdom — the Information Commissioner's Office (ICO); in California — the California Privacy Protection Agency / Office of the Attorney General; in the Philippines — the National Privacy Commission (NPC); in the Russian Federation — Roskomnadzor; in Ukraine — the Ukrainian Parliament Commissioner for Human Rights (Office for Personal Data Protection).
• 4.8. The law and supervisory authority applicable in each participant's country are listed in our Data Protection by Country reference, and full details are in our Privacy Policy.

5. Photo and Video Usage (Media Release)

5.1. The participant grants the Organizer an irrevocable, royalty-free, perpetual, non-exclusive, worldwide license to use all submitted photo and video materials.

5.2. Such materials may be used in any form, including but not limited to:

• the Website
• social media platforms
• advertising and marketing campaigns
• promotional, informational, and presentation materials
• current and future projects of the Organizer

5.3. This consent applies to ALL contests on the Website, including future contests.

5.4. The license in this Section covers ALL content the participant submits to or publishes on the Website in any current or FUTURE format — including participation photos and videos, Finalist Diary reels and clips, captions, comments, audio and voice recordings, and any future content formats such as LIVE streams and live broadcasts — together with the participant's name, image, and likeness as they appear in such content.

5.5. Such content may be used, reproduced, edited, cropped, subtitled, translated, combined with other materials, and distributed for advertising, marketing, and promotional purposes — including organic posts and PAID advertising campaigns on social media, search, video, and any third-party advertising networks — in any media and on any platforms, current or future, without additional consent, notice, approval, or compensation of any kind.

5.6. The participant warrants that they hold all rights to the content they submit and irrevocably RELEASES the Organizer from any claims arising from the use of such content as described in this Section — including without limitation claims based on privacy, publicity, image rights, moral rights, or reputation. The Organizer is not liable for any reuse, copying, or distribution of published content by third parties.

5.7. The license granted in this Section is fully SUBLICENSABLE and TRANSFERABLE. The Organizer may allow its affiliates, contractors, and advertising, media, distribution, and platform partners to store, publish, promote, and advertise the content on the Organizer's behalf for the purposes described above, and may use the content to operate, promote, develop, and improve the Organizer's products and services. This applies to ALL of the participant's content, including Finalist Diary clips and reels together with their captions.

5.8. Publication and worldwide distribution of the contest profile. By submitting an application, the participant expressly consents to the publication and distribution (making publicly available to an unlimited number of persons) of their contest profile on the Website — including their name or displayed alias, age, country and city, height and weight, contest photos and videos, rating, ranking position, and contest status. The participant understands and agrees that this public profile is visible to ALL visitors and users of the Website worldwide, including users located outside the participant's country of residence or citizenship; that it may be indexed and cached by search engines and displayed in search results; and that it may be viewed, shared, or copied by anyone with internet access. This consent covers cross-border display and transmission of the profile in every country of the world. Copies of published content may persist for a limited period in caches, backups, and third-party search indexes even after removal from the Website.

6. Intellectual Property Rights

• 6.1. Submitted materials may be edited, adapted, shortened, translated, combined with other materials, and used as part of derivative or collective works without additional consent.
• 6.2. The participant irrevocably waives any claims for royalties, compensation, remuneration, or removal of materials after publication.
• 6.3. Withdrawal of consent does not affect materials already published or used.

7. Contact Information, Public Visibility, and Participant-to-Participant Communication

• 7.1. Providing contact information is voluntary.
• 7.2. If the participant chooses to make contact details public, they acknowledge that such data may be accessed by third parties and that the Organizer has no control over subsequent use.
• 7.3. All responsibility for consequences of publishing contact information rests solely with the participant.
• 7.4. By participating, the participant consents to being contacted by NEW or existing contestants — as well as by Organizer staff — for questions, help, guidance, and other matters reasonably related to the contest and to participation. Such communication is supportive in nature (for example, a new contestant asking a more experienced one for advice on photos, videos, or the process) and is intended to make the contest welcoming to newcomers.
• 7.5. The Organizer does not monitor, moderate, or guarantee the content of participant-to-participant communication. Any communication between participants is voluntary, takes place outside the Website, and is at the participant's own risk. Harassment, spam, threats, or any unlawful behaviour are strictly prohibited and grounds for immediate disqualification and account suspension.
• 7.6. A participant may opt out of receiving contact from other contestants at any time by writing to support@obcface.com with a request to restrict participant-to-participant contact, or by hiding public contact methods in their profile.

8. Voting, Algorithms, and Technical Limitations

• 8.1. Voting is conducted using automated systems and algorithms.
• 8.2. Participants acknowledge the possibility of technical errors, calculation issues, or manipulative or automated voting activity.
• 8.3. The Organizer reserves the right to filter votes, recalculate results, adjust rankings, or annul results at its discretion.
• 8.4. All decisions of the Organizer are final and binding.
• 8.5. Genuine support is welcome — a participant may invite friends, family, and acquaintances to vote for them. However, ARTIFICIALLY INFLATING votes is strictly prohibited, including without limitation: buying votes; using vote bots, auto-voting scripts, click farms, or any paid vote-boosting or vote-ordering service; creating, buying, or driving fake, bot, or incentivised accounts or followers to vote; or generating votes by any other automated or deceptive means that do not reflect genuine, voluntary human support.
• 8.6. Any participant who carries out, commissions, pays for, or knowingly benefits from such vote manipulation will be DISQUALIFIED, and their results, ranking, prizes, and bonuses may be annulled retroactively, at the Organizer's sole discretion (see also Sections 1.4 and 8.3).
• 8.7. COLLUSION WITH VOTE-BOOSTING SERVICES IS PROHIBITED. Participants must not negotiate with, agree with, or accept help from any third party — individuals, groups, "promotion teams", agencies, or services — that offers to inflate votes, "help win", or otherwise artificially influence contest results, whether for payment or for free. Any participant who receives such an offer MUST immediately report it to the Organizer by writing to the official e-mail support@obcface.com or by messaging any official OBC social media account, ideally attaching screenshots or other evidence of the offer.
• 8.8. A participant who accepts such an offer, or who receives one and fails to report it as required by Section 8.7, FORFEITS ALL payouts and rewards on the Website — including contest prizes, finalist and diary-clip bonuses, participation rewards, referral rewards, and any other payments — as well as any titles, badges, and distinctions, whether pending or already awarded (amounts already paid may be reclaimed), and is barred from participating in any future contests. Reporting an offer promptly and honestly never counts against the participant — it is the required and safe course of action.

9. Winners and Required Materials

9.1. Winners must, within seven (7) calendar days, provide:

• a winner confirmation video
• a portrait presentation video
• a full-body presentation video

9.2. Failure to provide required materials may result in loss of winner status and reassignment of the prize.

9.3. Weekly winners, Annual winners, and OBC Choice winners must have a complete Finalist Diary: at least one published reel clip for every day of the contest week. An incomplete diary may result in loss of winner status and reassignment of the prize.

10. Restrictions on Further Participation

10.1. A winner may not participate in other contests on the Website, including local, seasonal, annual, international, or special contests, unless explicitly permitted by the Organizer.

11. Prizes and Taxes

• 11.1. Prizes are provided "as is" and do not constitute employment income.
• 11.2. Participants are solely responsible for any taxes, duties, or reporting obligations under the laws of their country.

12. No Employment or Agency Relationship

12.1. Participation does not create any employment, agency, partnership, or representative relationship with the Organizer.

13. No Guarantee of Visibility

13.1. The Organizer makes no guarantees regarding exposure, views, promotion, or publication frequency.

14. Force Majeure and Limitation of Liability

14.1. The Organizer is not liable for failure or delay due to technical failures, sanctions, governmental actions, service outages, or force majeure events.

15. Third-Party Platforms Disclaimer

15.1. Contests are not sponsored, endorsed, or administered by third-party platforms, including Meta, Instagram, Facebook, TikTok, Google, or Apple.

16. Modification of Terms and Contest Termination

• 16.1. The Organizer reserves the right to modify these Terms, suspend, or cancel contests at any time without prior notice.
• 16.2. Continued use of the Website constitutes acceptance of the current version of the Terms.

17. Finalist Diary (Daily Video Clips)

• 17.1. Participants who reach the finalist stage are expected to keep a Finalist Diary — short, real-day video clips (10–25 seconds each) posted every day of the contest week.
• 17.2. Clips must be genuine and filmed on the same day, with no AI, filters, masks, or heavy editing. The participant should appear in most clips, showing their face, voice, and personality.
• 17.3. Diary clips are published on the participant's profile and play as Reels. They are subject to the same Media Release (Section 5), Intellectual Property terms (Section 6), and Organizer moderation as all other submitted materials.
• 17.4. Regular daily activity supports engagement and visibility. Inactivity or failure to maintain the diary may negatively affect a participant's standing, at the Organizer's sole discretion, and carries no guarantee of visibility (see Section 13).
• 17.5. Finalists who wish to claim the finalist bonus must post diary clips EVERY day of the contest week, with no missed days. Each day must contain at least four (4) moderator-approved clips, and each clip must show a DIFFERENT, genuine moment of that day. Duplicate, near-identical, repeated, or unapproved clips do not count toward the daily minimum of four.
• 17.6. Missing any day — or failing to reach four (4) approved, distinct clips on any day — forfeits eligibility for the finalist bonus for that contest week. Meeting the minimum does not by itself guarantee the bonus, which remains discretionary and subject to these Terms, moderation, and the Organizer's final decisions.
• 17.7. The finalist bonus is conditional on FULL compliance with ALL of these Terms, not the diary alone. Any material violation — including inaccurate or false information, prohibited or stolen content, vote manipulation (Section 8.5), operating more than one account, or attempting to deceive or pressure moderation — forfeits the bonus for that contest week even if the daily four-clip minimum was met, and any bonus already paid may be reclaimed by the Organizer. Genuine support from family, friends, and acquaintances is always permitted and never counts as a violation.
• 17.8. Attempts to game the daily minimum do not count and may forfeit the bonus and lead to disqualification. This includes, without limitation: re-uploading rejected or removed clips; splitting a single moment into multiple near-identical clips; posting pre-recorded, old, AI-generated, filtered, or heavily edited footage presented as genuine same-day content; and using additional or fake accounts. Whether a clip is approved and counts toward the daily minimum of four is determined solely by the Organizer's moderation, and that decision is final.

18. Live Streams and Broadcasts

• 18.1. The Platform may offer live video streaming features (“Live Streams”), including scheduled broadcasts featuring participants. The Organizer may publish, change, or cancel streaming schedules at any time at its sole discretion.
• 18.2. By hosting, joining, or appearing in a Live Stream, the participant consents to its real-time transmission and to its recording and storage. Live Streams and their recordings, excerpts, and clips are submitted materials fully covered by the Media Release (Section 5) and the Intellectual Property terms (Section 6), on the same irrevocable, perpetual, royalty-free, worldwide, sublicensable and transferable basis.
• 18.3. The Organizer may broadcast, simulcast, restream, re-publish, and promote Live Streams — live or recorded, in whole or in part — on the Platform and on the Organizer's official accounts and channels on third-party platforms and social networks, including without limitation Instagram, Facebook, TikTok, YouTube, X (Twitter), Twitch, and Telegram, worldwide. Content distributed on a third-party platform is additionally subject to that platform's own terms and policies, for which the Organizer is not responsible.
• 18.4. Participants must not include in a Live Stream any third-party content (including recorded music or performances) or any identifiable third persons without all rights and consents needed for the uses described in these Terms. The Organizer may moderate, mute, delay, cut, or terminate any Live Stream at any time at its sole discretion.
• 18.5. Live Streams are offered only where lawful (Section 1.5 applies) and their availability may be restricted or withheld in any jurisdiction. Participation in Live Streams carries no guarantee of visibility (Section 13) and, unless expressly stated otherwise, no separate remuneration.
